Liability Waiver

All clients are required to read and sign our liability waiver before they can participate in any Fit5 Studio classes. Classes at Fit5 Studio may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury or property loss. Neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against LivFit, LLC or its members for any personal injury or property damage/loss whether caused by negligence or otherwise. The required waiver removes all liability from Fit5 Studio AND authorizes Fit5 Studio to charge the credit card on file for late cancels and no shows. PRIOR TO SIGNING THE LIABILITY WAIVER PLEASE READ CAREFULLY, UNDERSTAND FULLY, AND ASK QUESTIONS IF ANYTHING IS UNCLEAR. WE ARE HERE TO SUPPORT YOU. MAKE SURE YOU UNDERSTAND THE WAIVER.  BY SIGNING THE WAIVER, YOU ARE SIGNING AWAY YOUR LEGAL RIGHTS AND YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS WAIVER.

Privacy Policy

LivFit, LLC understands the importance of privacy and we want you to be as comfortable as possible when using our website and services. Please read this privacy policy before using the site or submitting any personal information. By using the site, you are accepting the practices described in this privacy policy. These practices may change, but any changes will be posted and changes will only apply to activities and information on a “going forward” basis. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used. Note: The privacy practices set forth in this privacy policy are for this website only. If you link to other websites, please review the privacy policies posted at those sites.

We collect certain personal information, such as names, postal and email addresses, credit card information etc., when voluntarily submitted by our clients. The information you provide is used to fulfill your specific request, to improve the experience on our website, and to ensure a successful experience at LivFit, LLC. We may also use a User”s email address to send updates, a newsletter or news regarding LivFit, LLC.

Users may elect not to receive these emails by following opt-out instructions. LivFit, LLC reserves the right to send you important notices about your account even if you opt out of all voluntary email notifications.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Late Cancel Policy

All clients who reserve a spot in class will be subject to late cancel policy fees.

If you sign up for class and cannot make it, please cancel your reservation online or through the Fit5 app at least 12 hours before your class start time. This will allow enough time for clients on the waitlist to be added into the class.

If you late cancel (within 12 hours prior to the class start time), you are subject to the fees listed below:

– Unlimited Members: $20 fee will be processed

– Limited Memberships: A class will be deducted from your account

– Class Pack Holders: A class will be deducted from your class pack

– Drop-In: No refund will be processed and drop-in is not transferrable to another date and time

Please Note: Due to our waitlists, all late cancellations are subject to the fees listed above. You can NOT book another class in the same day to avoid the late cancellation fee. If you are on a waitlist and a spot opens up for you an hour or later before the class start time, you will be subject to the late cancel fees listed above. Please remove yourself from the waitlist at least 12 hours beforehand if you no longer plan to attend if a spot becomes available. 

All fees are non-refundable!! 

– All cancellations must be done through the Fit5 app or online. If technology is not your friend that day, please email us at info@fit5studio.com

No Show Policy

All clients who reserve a spot in class will be subject to no show policy fees.

If you do not show up for your scheduled class you will be subject to the no show fees listed below:

– Unlimited Members: $25 fee will be processed

– Limited Memberships: A class will be deducted from your account AND a $25 fee will be processed

– Class Pack Holders: A class will be deducted from your class pack AND a $25 fee will be processed

– Drop-in/Single Class: No refund will be processed and drop-in is not transferrable to another date and time

Please note: You can not book another class in the same day to avoid the no-show fees. 

All fees are non-refundable!!

Guest Passes

Guests are subject to our late cancel and no show policies listed above. If you, the client, signed your guest up you will be responsible for the late cancel/no show fees. 

Sick Policy

If you become ill, please make sure you cancel your reservation. If you are past your early cancelation window, please email us right away. Late cancelation fees will be waived if you are sick. The health and safety of our clients and staff is our top priority. If you test positive or are exposed to COVID please do not come to the studio for at least 5 days.

Arrival

Please arrive at least 10 minutes before the start of class. If you arrive 5 minutes or more after the start of class, you will not be allowed to enter the studio and you will be subject to the late cancel fees. Your spot may be given to another client on standby. We do not allow you to enter the studio late, due to the disruption of our other clients who have started their workout. Please contact us if you are running late. 

Waitlist 

If a class is full, you can add yourself to the waitlist through the Fit5 app or online. Please enable email/text alerts in your Fit5 account so you are notified if you are added to the class. If you are not receiving alerts, please contact us right away so we can adjust your notification settings. Please note, you will be subject to late cancel fees if you are added to the class at least one hour or more prior to the class start time. If you can no longer attend class please be mindful to remove yourself from the waitlist. 

Cell Phone Policy 

Out of respect for our clients and instructors, no use of cell phones are allowed during class. Please remember that this is your time to disconnect and focus on yourself. Our instructors guide you through each move and if you are on your cell phone you will miss key instructions that could cause injury. We understand emergencies happen. Please be respectful and take your call or text outside.

Kids 

Due to safety concerns and respect to other clients and our instructors, children and anyone not taking class are not allowed in the studio during class. Make each class YOUR 45 minutes to unwind, disconnect and focus on yourself.

Class Limit

Due to demand we only allow each client to take one class per day

Inclement Weather

Due to the nature of Fort Collins weather, our goal is to be a reliable business but not to put our staff or clients in a compromising situation.

  • Any classes 5am-8am – Decision will be made the night before by 9pm.
  • Any classes 8:30 am+ will be decided 2 hours prior to the scheduled class time.
  • Fit5 Studio will be contacting you via email if there is a class cancellation due to inclement weather. Please update your email and cell phone information in your Fit5 account. Postings will also be made on Fit5 Studio Instagram and Facebook page.
  • In the event that there are electrical outages in the area please provide a cell phone number.

You will NOT be charged for any cancelled classes that we, Fit5 Studio, cancel due to inclement weather. You will be automatically “early” cancelled in the system. If YOU choose to cancel in less than 8 hours in advance, you will be charged for that class.

Memberships

Contracts are billed on a monthly recurring basis

Each contract has its own minimum monthly commitment. By purchasing a membership with a commitment, the client understands they are legally bound to fulfill every payment within the contract terms.

Once your initial commitment is fulfilled, your membership will auto-renew on a month-to-month contract unless a cancelation request is sent via email at least 14 days before your charge date. Please feel free to reach out to us if you have questions about membership contracts.

If you would like to change your monthly membership package, you must fulfill your current contract before you can downgrade your membership. Written notice must be given at least 14 days before your auto renew date.

Fit5 reserves the right to terminate/suspend your booking privileges until all past due/unpaid balances are fulfilled. Client understands that they will be responsible and liable for any fees including attorney fees and collection costs that Fit5 may incur in its efforts to collect any past due or unpaid balances from you.

To cancel any auto-renew membership (which has completely fulfilled it’s minimum monthly commitment) a written notice at least 14 days before renewal must be submitted via email.

Memberships begin on the date of purchase

Unused limited membership classes do not roll over (4x, 8x & 12x month). Use them or lose them!

Guest passes can only be used for local residents. Guest passes do not roll over to next month

Class Packs

Class packs expire 6 months from date of purchase.

Private Sessions – Late Cancel Policy

All private session clients are subject to late cancel/no show policy fees. If you cancel your private session within 24 hours of the start time, the private session will be deducted from your account AND a $50 late cancel fee will be processed.
